Incorporation of a Business Group
The Business Groups Incorporation Act provides for:

 

  • the incorporation of customary groups for business and other economic purposes; and

  • the control and regulation of the conduct of business by such groups, and for related purposes.

  •  

The purpose of the Act is to provide:

 

  • greater participation by local people in the national economy by the establishment of group business and other economic enterprises;

  • for the use of sound principles in the management of business; and

  • some format structure of business groups for the basic protection of the members of business groups and persons dealing with those groups; and

  • for the use of simple rules for the regulation and control of business groups; and

  • for the better and more effective settlement of certain disputes, by

  • the incorporation of certain customary and similar groups, and conferring on them, as corporation, power to:

       (i) conduct business enterprises; and           

       (ii) borrow money; and

       (iii) acquire, hold, dispose of and manage land, and of ancillary powers; and

         the encouragement of self-resolution of disputes within such groups, without requiring recourse to non-traditional courts.

 

How to Incorporate a Business Group


Under the Business Groups Incorporation Act Chapter 144 an Application for Incorporation consists of four (4) forms:

 

  • Form A: Application for Incorporation;

  • Form B: Comments by the Proposed Dispute Settlement Authority for the proposed "__________ Business Group (Inc)" as required by Section 12 (1)(a) of the Act;

  • Form C: Comments by Business Development Officer; and

  • Form D: Draft Constitution
